How should she deal with her husband who drinks alcohol?

 

I am young muslim woman who has 3 children and a good husband. I try my best to adhere to Islam as best as I can for fear of Allah in this world and in the hereafter. I just recently stopped many of the haram actions myself (like drinking alcohol) and am trying to stick with a religious life. My husband, despite him being a good husband, drinks alcohol. He drinks almost every other day and sometimes goes out and stays out till one or two in the morning. This makes me very angry and I have a hard time controlling my anger. I used to shout at him, but now I managed to keep my mouth shut. But my mood always gets bad when he drinks. Is it permissible to show a bad mood to him to let him know I dont like it? If I dont say anything to him and always be cheerful and stay in a good mood with him, he is sooo happy and will do anything for me. Sometimes he drinks in front of me also. How should I act in this situation? Should I show my disapprovement or should i just stay quiet and make dua for him and not show any anger? It is really hard. I am having alot of anxiety about this but this Alhamdullilah is the only bad part of my marriage. Other than this, he is doing everything for our family. I really want him to stop drinking. I am reading alot of darood sharif, which I read makes ones problems go away but I get very sad sometimes for fear that my children will adopt this habit and that my husband will not change. I love him very much but this problem is making it hard for me to take care of my children and live my daily life because of the distress. I feel maybe that if I use as much kindness and love, that maybe he will listen and change, Inshallah.

Alcohol is the mother of all evils and its bad effects on
religious commitment and physical and mental health are no secret to
anyone who has any insight. Some of those bad effects have been discussed

The prohibition on alcohol is not limited to the matter of
drinking it; rather it includes pressing or squeezing (the grapes etc),
carrying it, selling it and being present in a gathering where it is drunk.
Hence the shar‘i text which mentions it speaks in terms of avoidance. Allah
says (interpretation of the meaning):

“O you who believe! Intoxicants (all kinds of alcoholic
drinks), and gambling, and Al‑Ansaab (stone altars for sacrifices to idols
etc) and Al‑Azlaam (arrows for seeking luck or decision) are an abomination
of Shaytaan’s (Satan’s) handiwork. So avoid (strictly all) that
(abomination) in order that you may be successful”

[al-Maa’idah 5:90]. 

Shaykh Muhammad al-Ameen al-Shanqeeti said: Avoiding
something means keeping away from it, so that you are not present where it
is being done.

Hence it is not permissible for you to sit with your husband
when he is drinking alcohol and there is no room for being “polite” in that
regard. Rather what you have to do is exhort him, advise him and remind him
of Allah. If he does not respond to you, then do not sit with him when he is
drinking it.

It was narrated that Abu Sa‘eed al-Khudri (may Allah be
pleased with him) said: I heard the Messenger of Allah (blessings and peace
of Allah be upon him) say: “Whoever among you sees an evil action, let him
change it with his hand (by taking action); if he cannot, then with his
tongue (by speaking out); and if he cannot, then with his heart (by hating
it and feeling it is wrong), and that is the weakest of faith.”

Narrated by Muslim (49). 

Denunciation in the heart is what happens when a person feels
distressed and sad in the presence of an evil action. This is contrary to
showing happiness and joy at what your husband is doing, or showing that one
does not care about the evils that are being committed. 

Nevertheless, screaming or yelling at him in such situations
will never work. Hence you should strive to control your anger and call him
in a kind and gentle manner with beautiful exhortation from time to time,
whilst praying for him in his absence that he be guided, seeking out times
when supplications are answered, especially the last third of the night. 

Strive to give your children a sound upbringing and keep them
from seeing or touching this evil. At the very least you can ask your
husband not to drink alcohol in front of them, until Allah guides him and he
repents from drinking it. 

We agree with you that your actions when they are filled with
love and compassion are more effective and more likely to be accepted. Hence
the Messenger (blessings and peace of Allah be upon him) enjoined us to be
kind and he said: “There is no kindness in a thing but it adorns it, and it
is not taken away from a thing but it makes it defective.” Narrated by
Muslim (2594). 

So tell him that you want what is good for him and that you
want him to be dignified and respected by people and to be a good example in
all things, as he is in his dealings with you… And other such words which we
hope will have an affect on him. 

We ask Allah to help you to
do all that is good and to guide your husband to the best of attitudes,
words and actions.

He made an e-mail account for his friend, who used it for sinful purposes; should he close it down without telling him?

 

I made an e-mail account for one of my friends, and I found out he had been using it for sinful purposes, so I closed his e-mail account without telling him and I do not want him to know. Is that permissible or not?.

Praise be to Allaah.

If you made the e-mail account for your friend or let him
use your account and it became his, and he is responsible for it, you do
not have the right to look at what is in it or to close it without him
knowing, because of the sanctity of the property and honour of the Muslim.
It is not permissible to spy on him or to dispose of this property or to
spoil its benefits. The way for you to deal with it is to advise him,
remind him and speak out, within the proper guidelines. 

If you gave him an e-mail account by way of lending it to him
to use it for a while, and he used it for haraam purposes, then you can do
whatever you think is best, either closing it or advising and warning him,
because the e-mail address is still your property, so it is permissible to
you to dispose of it as you see fit. 

You should advise your friend in either case and explain to
him the seriousness of sin so that he will not go back to it if he gets
another e-mail account.

Ruling on using smokeless tobacco; does it break the fast?

 

My father suffers from anxiety, tension and depression, and he has been using a remedy for 10 years. From the beginning of Ramadan this year he experienced increased anxiety and could not sleep until 10 a.m. For a long time he has been using smokeless tobacco (which is a form of tobacco that is placed inside the mouth, under the lower lip -- sometimes known as “dipping tobacco” or “moist snuff”). He has been using it for twenty-five years and he used it in Ramadan this year. He also used it last year during the fast because, according to what he says, it reduces the pain and anxiety he is suffering from. What does he have to do with regard to those days when he broke the fast (if it is regarded as breaking the fast)? It was approximately 13 days this year and 5 days in Ramadan last year. Should he also feed the poor?.

Praise be to Allaah.

Firstly: 

We ask Allah, may He be exalted, to give you and your father,
and all the Muslims, well-being, for He is most generous and kind. 

Secondly: 

“Smokeless tobacco” is a type of tobacco that is not burned
and may be mixed with other substances; it is used by some people who place
it in their mouths. The ruling on this substance is no different from the
ruling on cigarettes. 

Shaykh ‘Abd-Allah ibn Jibreen (may Allah have mercy on him)
said:

There is no doubt that cigarettes, nargilah (shisha),
smokeless tobacco and the like are haram, because they are all evil and
unlawful. Allah says (interpretation of the meaning):

“He allows them as lawful
At-Tayyibât (i.e. all good and lawful as regards things, deeds, beliefs,
persons, foods), and prohibits them as unlawful Al-Khabâ’ith (i.e. all evil
and unlawful as regards things, deeds, beliefs, persons and foods)”

[al-A ‘raaf 7:157]. 

And because they damage people’s health and cause serious
diseases that may lead to death, and Allah says (interpretation of the
meaning):

“And do not kill yourselves”

[al-Nisa’ 4:29]

“and do not throw yourselves into destruction”

[al-Baqarah 2:195]. 

And because it is extravagance and a waste of money on
something that is of no benefit, and the spendthrifts are the brothers of
the devils (cf. 17:27). We advise anyone who is tested with any of these
things to repent and give it up immediately, and to resolve not to go back
to it, and to seek the help of Allah in quitting it, and to be patient for a
few days until he is able to give it up completely and put an end to the
pain that it causes him. And Allah is the Healer. End quote from Fataawa
Islamiyyah, 3/446 

Thirdly: 

Smokeless tobacco breaks the fast, because when it is placed
in the mouth it dissolves and some particles of it enter the stomach with
the saliva. 

The scholars of the Standing Committee were asked: 

What is the ruling on using smokeless tobacco in general, and
what is the ruling on using it during the day in Ramadan in particular? Does
it break the fast if someone uses it during the day in Ramadan? Please note
that some of the people of Tihaamah Qahtaan use smokeless tobacco during the
day in Ramadan and claim that it does not break the fast.

 They replied: Smokeless tobacco is an evil substance because
it is composed of an evil, haraam substance. If it is used by one who is
fasting, in addition to it being sinful, it also breaks his fast, the same
as any other substance that breaks the fast. 

And Allah is the source of strength. May Allah sent blessings
and peace upon our Prophet Muhammad and his Family and Companions. End
quote.

‘Abd-Allah ibn Ghadyaan, Shaykh Saalih al-Fawzaan 

Fataawa al-Lajnah al-Daa’imah,

Based on this, your father has to make up the days that he
broke the fast by using smokeless tobacco during last Ramadan and the one
before. But if your father did not know that smokeless tobacco breaks the
fast, then his fast is valid, because the one who fasts is excused for
ignorance of what breaks the fast.

You should try to advise your father to give up this evil
substance. Tell him that it is of no benefit in treating insomnia and
anxiety; rather it causes more insomnia and anxiety. We ask Allah to guide

Is it permissible for children to draw pictures of animate beings?

 

Is it permissible for children to draw animals or living beings?.

Praise be to Allaah.

Firstly: 

It is not permissible to
draw and make images of animate beings, whether they are engraved, on paper,
on cloth or anything else, because of the report narrated by al-Bukhaari
(2105) and Muslim (2107) from ‘Aa’ishah the Mother of the Believers (may
Allaah be pleased with her), that she bought a cushion on which there were
images. When the Messenger of Allaah (peace and blessings of Allaah be
upon him) saw it, he stood at the door and did not enter. She said: I
recognized displeasure in his face. I said: O Messenger of Allaah, I repent
to Allaah and His Messenger, what have I done wrong? The Messenger of Allaah
(peace and blessings of Allaah be upon him) said: “What is this
pillow?” She said: I bought it for you to sit on and recline on. The
Messenger of Allaah (peace and blessings of Allaah be upon him) said:
“The makers of these images will be punished and it will be said to them,
‘Bring to life that which you have created.’” Then he said: “The house in
which there are images is not entered by the angels.”  

And Muslim (2110) narrated
that Sa’eed ibn Abi’l-Hasan said: A man came to Ibn ‘Abbaas and said: I am a
man who makes these images; advise me about that. He said to him: Come close
to me. So he came closer to him. He said: Come closer to me. So he came
closer to him, until he put his hand on his head and said: I will tell you
what I heard from the Messenger of Allaah (peace and blessings of
Allaah be upon him). I heard the Messenger of Allaah (peace and
blessings of Allaah be upon him) say: “Every image maker will be in Hell,
and for every image that he made, a soul will be created which will punish
him in Hell.” He said: If you must do that, then make (images of) trees and
inanimate things. 

Al-Nawawi (may Allaah have
mercy on him) said in Sharh Saheeh Muslim: Our companions and other
scholars said: Making images of animals is emphatically haraam and is a
major sin, because this stern warning which is mentioned in the ahaadeeth is
issued concerning it. That applies whether he makes it to be used in ways
that are not respectful or otherwise. Making it is haraam in all cases,
because it is competing with the creation of Allaah. That applies whether
the image is in a garment or a carpet or a dirham or a dinar or a penny or a
vessel or a wall or anything else. As for making images of trees, camel
saddles and other things in which there are no images of animals, that is
not haraam. End quote. 

It says in Fataawa
al-Lajnah al-Daa’imah (1/479): What makes images forbidden is the fact
that they are images of animate beings, whether they are sculptures, or
drawings on walls or fabric or paper, or they are woven, and whether they
are done with a quill, a pen, or a machine, and whether they represent
something real or something imaginary, whether they are small or large,
beautified or distorted, or drawn in the form of lines representing a
skeleton. What makes them forbidden is that fact that they depict animate
beings, even if they are imaginary like pictures of ancient people,
Pharaohs, or leaders and soldiers of the Crusades, or like the pictures of
‘Eesa (Jesus) and Maryam (Mary) that are kept in churches, etc., because of
the general  meaning of the texts, and because that is competing with the
creation of Allaah, and because it is a means that leads to shirk. End
quote.  

Secondly: 

Even if the child is not
yet accountable, his guardian should prevent him from doing haraam things
and discourage him from doing them, so as denounce evil and to train the
child and make him get used to what is good. 

Allaah says (interpretation
of the meaning): 

“O you who believe! Ward
off yourselves and your families against a Fire (Hell) whose fuel is men and
stones, over which are (appointed) angels stern (and) severe, who disobey
not, (from executing) the Commands they receive from Allaah, but do that
which they are commanded”

[al-Tahreem 66:6] 

And the Prophet (peace
and blessings of Allaah be upon him) said: “Each of you is a shepherd and
each of you is responsible for his flock. The ruler of the people is a
shepherd and is responsible for his flock. A man is the shepherd of his
household and is responsible for his flock. A woman is the shepherd of her
husband’s house and children and is responsible for her flock.”

Narrated by al-Bukhaari
(893) and Muslim (1829). 

The child’s guardian should
raise him to keep away from making images and drawing animate beings, and he
should explain to him that this is haraam. 

He should look for
permissible alternatives that are available, praise be to Allaah, such as
drawing vegetables, fruits, trees and oceans, and any inanimate objects.

Taking pictures of student activities with a video camera and digital camera

 

What is the ruling on recording by video cameras and digital cameras in schools, in order to document the activity and submit it to the administration, as per their request?.

Praise be to Allaah.

It is permissible to take
pictures of student activities with the video camera and digital camera
mentioned, for the purpose of documenting the activity so that the
administrators may study it, so long as these images are not produced in any
fixed format such as on paper. 

Shaykh Ibn ‘Uthaymeen
said: 

With regard to pictures
made in the modern fashion, they fall into two categories:   

The first category is those
which have no tangible substance (and can only be seen by running them
through a machine), as I was told is the case with pictures on video tapes.
There is no ruling at all concerning these, and they do not come under the
prohibition at all. Hence the scholars who forbid making pictures with
cameras on paper (photographs) permitted this (video pictures), and said
that there is nothing wrong with this. Then it was asked, is it permissible
to film lectures which are given in the mosques? The (scholarly) view was
that it is better not to do that, because it may disturb the worshippers and
because they may film things that may not be appropriate, and so on.   

The second category is
fixed or still pictures on paper (photographs) … 

But the matter needs
further discussion if one wants to make these kind of permissible pictures.
For they are subject to five rulings which depend on the intention. If the
intention is something forbidden, then it is haraam. If he intends something
waajib (obligatory), then it is waajib. Sometimes pictures may be essential,
especially moving pictures. For example, if we see someone in the act of
committing a crime against a person’s rights, such as an attempt to kill and
so on, and we cannot prove it in any way but by taking pictures, then in
this case taking pictures becomes waajib, especially in cases where pictures
may decide the case. The means are subject to the rulings on the ends. If we
make these pictures in order to prove the identity of a person for fear that
someone else may be accused of the crime, this is also acceptable, indeed it
is essential.   

But if we take these
pictures just to enjoy looking at them, this is undoubtedly haraam...

Shaykh ‘Abd al-‘Azeez ibn
Baaz (may Allaah have mercy on him) was asked: What is the ruling on
videotaping celebrations, conferences and seminars? 

He replied: If there is the
hope that people may benefit from the videotaping of the party, seminar or
Islamic meeting in which there is the call to Allaah, and it is believed
that this is most likely to serve a good purpose and that this videotaping
will be good and will benefit the people, then there is nothing wrong with
that in sha Allaah. End quote from Fataawa Islamiyyah (4/367). 

May Allaah help us all to
do that which He loves and which pleases Him.

Taking a picture of a man with his friends

 

Is it haraam to take a picture of a man with his friends?.


Praise be to Allaah.
 

 

Undoubtedly making images of everything that
has a soul is haraam, indeed it is a major sin, because of the stern warning against that narrated in the texts of the Sunnah; and because it is
imitating Allaah in His creation of living things; and because it is a means that leads to temptation (fitnah) and that often leads to shirk. The
one who takes the picture, the one who tells him to do it and those who help him to do it are all guilty of sin, because they are cooperating in
sin, which Allaah has forbidden when He said: 

“but do not help one another in sin and
transgression”

[al-Maa’idah 5:2] 

And Allaah is the Source of
strength.                                         

Fataawa al-Lajnah al-Daa’imah
(Fatwas of the Standing Committee), 1/454 

According to another fatwa issued by the
Standing Committee (1/458): 

It is not permissible to make pictures of animate beings using cameras or any other kind of
image-making equipment, or to keep pictures of animate beings except in cases of necessity, such as pictures in identity documents or passports;
it is permissible to take and keep such pictures because there is a need for that.

Ruling on caricatures

 

What is the ruling on caricatures and those which are seen in some newspapers and magazines, which includes drawings of people?.

Praise be to Allaah.

The drawings mentioned are not permissible. They are among
the widespread evils which must be given up because of the general meaning
of the saheeh ahaadeeth which indicate that it is haraam to make images of
any animate being, whether by machine, by hand or by any other means. 

For example, al-Bukhaari narrated in his Saheeh that
Abu Juhayfah (may Allaah be pleased with him) said: The Prophet (peace
and blessings of Allaah be upon him) forbade the price of a dog and the
price of blood, and he forbade (the actions of) the woman who does tattoos
and woman who has that done, and the one who consumes riba and the one who
pays it, and he cursed the image-maker.  

It is also narrated in al-Saheehayn that the Prophet
(peace and blessings of Allaah be upon him) said: “The people who will
be most severely punished on the Day of Resurrection will be the
image-makers.” And he (peace and blessings of Allaah be upon him) said:
“The makers of these images will be punished on the Day of Resurrection and
it will be said to them: ‘Give life to that which you have created’.”  

And there are many other sound ahaadeeth on this topic. No
exception is made to that except cases where pictures are necessary, because
Allaah says (interpretation of the meaning): “while He has explained to
you in detail what is forbidden to you, except under compulsion of
necessity” [al-An’aam 6:119].  

I ask Allaah to enable the Muslims to adhere to the laws of
their Lord and to adhere to the Sunnah of their Prophet (peace and
blessings of Allaah be upon him), and to avoid that which is contrary to
that, for He is the best One to be asked. End quote.

Repentance of the Fornicator

 

Assalaamu'alaikum.

I have a friend. He has married. He told me, someday he did 'Zinnah' with other
woman. Now, he want to Taubat An-Nasuha. The Questions are :

  1. How can he do a Taubat An-Nasuha ? Would be Allah 'azza wa jalla receive
    his Taubat ?
  2. He told me, (I'm sorry if sounds rough), his penis did not entered to the
    woman's vagina, but their condition have been nude. His penis position
    between her up leg. Could we say that is a zinna that must be punished with
    'rajm' ?

As information, In our country, the zinna can't punish with 'rajm'. I need your
answer soon as possible.

Praises are Due to Allah

The
act that your friend committed is a great sin and crime. He must repent to Allah.
The Prophet (peace and blessings of Allah be upon
him) said: "the eyes fornicate, the hands fornicate, the legs commit
fornication, and the private parts commit fornication". (It is reported
by Ahmad and it is in sahih Al Jahni 4150.)

Tell
your friend that he has to increase in good deeds so that Allah will wipe out
his evil deeds, as Abdullah ibn Masud reported. He said that a man came to the
Prophet (peace and blessings of Allah be upon him) and said, ‘Oh Messenger
of Allah (peace and blessings of Allah be upon
him), I met a woman in the garden so I pulled her close, fondled her, kissed
her, and did everything with except have intercourse. The Prophet
(peace and blessings of Allah be upon him) was then silent and so the verse
came down, "verily, the good deeds erase the bad deeds, that is admonition
to those who remember." So the Prophet (peace and blessings of Allah
be upon him) called him and recited it to him. So Umar (may Allah be pleased
with him) said, ‘Oh Messenger of Allah (peace
and blessings of Allah be upon him) is this for him specifically or for everyone.
He said (peace and blessings of Allah be upon him)
, ‘no, for everyone.' (It was narrated by Ahmad.)

As for your question regarding whether he is considered to have committed fornication,
which is punishable by stoning, it is obligatory that the married fornicator
be stoned and the unmarried fornicator receive lashes. This is only if the sexual
organs of the fornicator penetrate the vagina of the woman. Whatever is similar
deserves a different punishment, depending on the level of the haram committed.
It is not obligatory that he admit to a judge what he did. It is sufficient
that repentance take place between him and Allah, and Allah is the Acceptor
of repentance and the Most Merciful. We ask Allah to forgive us and the rest
of the Muslims.

A woman who committed adultery and is contemplating suicide

 

A married woman commits adultery, then she repented but the guilt of the act is haunting her. She is now
thinking about suicide. What should be done and what is your advice?


Praise be to Allaah.



Ibn Mas'ood (may Allaah be pleased with him) said: "The believer sees his
sin as a mountain beneath which he is sitting and which he fears may fall
down upon him. The rebellious person sees his sin as a fly which passes in
front of his nose and he swats it away…" (Reported by al-Bukhaari, 6308)



This woman's overwhelming sense of the burden of her sin is a sign of
faith. We offer her the following advice:

She should examine her divorce from her first husband to make sure
that it is sound according to sharee'ah (Islamic law), whether it took the
form of talaaq (male-instigated divorce) or khul' (female-instigated
divorce).

She should make sure that her marriage contract to the second man is
also sound, because a marriage between two people guilty of adultery is
not valid unless they have repented (see questions # 33); if the contract
is found not to be valid, it must be repeated.

If this woman is sincere in her repentance towards Allaah, regrets what
she did and is determined never to do it again, Allaah will forgive all
her sins, no matter how great they were, so she should not despair of
the mercy of Allaah, for no one despairs of Allaah's Mercy, except the
people who disbelieve, and who despairs of the mercy of his Lord
except those who are astray?

She should hasten to do many good deeds, to expiate for her sin, as
Allaah says (interpretation of the meaning): "And perform al-salaat (the
prayer) at the two ends of the day and in some hours of the night.
Verily, the good deeds remove the evil deeds…" [Hud 11:114]

She should resume a pure Islamic life, based on purity and chastity.
Suicide is not a solution at all, as it is one of the most grievous of major
sins, and will only increase the punishment of the one who does it. The
Prophet SAWS (peace and blessings of Allaah be upon him) said:
"Whoever throws himself down from a high mountain and kills himself
will be throwing himself down from a mountain in the Fire of Hell for
all eternity. Whoever takes poison and kills himself will be taking
poison in the Fire of Hell for all eternity. Whoever kills himself with a
weapon (literally, iron) will be holding it in his hand and stabbing
himself in the stomach in the Fire of Hell for all eternity. (Reported by
al-Bukhaari, 5778)

We ask Allaah to help this woman to repent sincerely, to forgive her sins
and to include her in His Mercy, for He is the All-hearing Who answers
prayers

Praise be to Allaah and peace and blessings be upon the
Messenger of Allaah.

Zinaa (fornication or adultery) is a crime that is forbidden by divine
laws and rejected by all wise and sane people, even if they are not Muslim. Allaah has
condemned those who do this in many aayaat of the Qur’aan and in numerous ahaadeeth
of His Prophet
(peace and blessings of Allaah be upon him). He has threatened those who
do this with severe punishment and disgrace in this world and the next – except those
who repent, have faith and do righteous deeds, for Allaah will accept their repentance.
The gate of repentance is open, but it is a condition of repentance that one should regret
the deed and give it up. Islam wipes out whatever came before.

With regard to the child, he belongs to his mother, and should not be
named after his father. This is the ruling concerning the illegitimate child: he should
not be named after his father because he was conceived in fornication, not in wedlock. It
is obligatory to take care of this child and bring him up with Islamic manners and morals.
Because this immoral act has occurred, you must repent from it, but you should cover it up
and not disclose it; you do not have to tell the people the truth. If the child wants to
know the truth, you can tell him in an appropriate manner, and let him know that what
happened was in the days of kufr (before you became Muslim), and that when a person
repents and becomes Muslim, this wipes out whatever happened before. The child does not
bear any responsibility for what happened, and as long as his mother has become Muslim,
there is no grounds for rebuking or punishing her. It is obligatory to accept the will and
decree of Allaah, and if this child does righteous deeds he will enter Paradise. No soul
is made to bear the burdens of another. We ask Allaah to keep you safe and sound and to
forgive you. May Allaah bless our Prophet Muhammad.

Ruling on honour killings

 

I would like to know what the ruling on Honor killings would be and how it should be punished acording to the Laws of the Shariat.

Praise be to Allaah.

Killing a Muslim unlawfully
is a serious matter and a grave crime. Allaah says (interpretation of the
meaning): 

“And whoever kills a
believer intentionally, his recompense is Hell to abide therein; and the
Wrath and the Curse of Allaah are upon him, and a great punishment is
prepared for him”

[al-Nisa’ 4:93] 

al-Bukhaari (6355) narrated
from Ibn ‘Umar (may Allaah be pleased with him) that the Messenger of Allaah
(peace and blessings of Allaah be upon him) said: “The believer will
continue to be encompassed by the mercy of Allaah so long as he does not
shed blood that it is forbidden to shed.” 

 

The Prophet (peace and
blessings of Allaah be upon him) has explained to us the reasons for which
it becomes permissible to shed this blood. He said: “It is not permissible
to shed the blood of a Muslim who bears witness that there is no god but
Allaah and that I am the Messenger of Allaah except in three cases: a life
for a life (murder), zina of one of who is previously-married (adultery),
and the one who changes his religion and forsakes the jamaa’ah.” Narrated by
al-Bukhaari (6370) and Muslim (3175). From this it is clear that zina on the
part of one who is married is one of the reasons that make it permissible to
kill a person, but the zaani (adulterer) cannot be killed unless two
conditions are met:

He should be
previously-married. The scholars have explained what is meant by
previously-married in this case. Zakariya al-Ansaari (may Allaah have mercy
on him) said in Asna’l-Mataalib (4/128): The previously-married
person, whether male or female, is any adult of sound mind who has
previously had intercourse within a valid marriage. End quote. Shaykh Ibn
‘Uthaymeen (may Allaah have mercy on him) said in al-Sharh al-Zaad
(6/120): There are five conditions for (being described as)
previously-married: 

1-   
Intercourse

2-   
Within a valid marriage

3-   
Being an adult

4-   
Being of sound reason

5-   
Being free (i.e., not a slave). 

End quote.

The second condition is
that it should be proven that the hadd punishment is deserved, by the
testimony of four male witnesses who saw the private parts meet, or the
person should freely admit to having committed zina, without being forced to
do so. 

If it is proven that he
deserves the hadd punishment, it is not permissible for individuals to carry
out this punishment themselves. Rather the matter must be referred to the
ruler or his deputy to prove the crime and carry out the punishment, because
if individuals carry out hadd punishments, that will lead to a great deal of
corruption and evil. 

Ibn Muflih al-Hanbali (may
Allaah have mercy on him) said in al-Furoo’ (6/53): It is haraam for
anyone to carry out a hadd punishment except the ruler or his deputy. This
is something on which the fuqaha’ of Islam are unanimously agreed, as was
stated in al-Mawsoo’ah al-Fiqhiyyah (5/280): The fuqaha’ are
unanimously agreed that the one who should carry out hadd punishments is the
ruler or his deputy, whether the punishment is transgressing one of the
limits of Allaah, may He be exalted, such as zina, or a transgression
against another person, such as slander. End quote. 

Concealing one who has
committed this evil deed so that he may repent and set his affairs straight
before he dies is better than exposing him, let alone killing him. The
Prophet (peace and blessings of Allaah be upon him) turned away from
Maa’iz (may Allaah be pleased with him) after he admitted committing zina,
and he ignored him until he had repeated his confession several times, then
he carried out the hadd punishment on him. 

Based on this, that which
is called “honour killing” is a transgression and wrongdoing, because it is
killing one who does not deserve to be killed, namely the virgin if she
commits zina (fornication), but the shar’i punishment in her case is
flogging and banishment for one year, not execution, because the Prophet
(peace and blessings of Allaah be upon him) said: “(The punishment for
zina) of a virgin with a virgin person is one hundred lashes and exile for
one year.” Narrated by Muslim. The one who kills her has killed a believing
soul whom Allaah has forbidden to be killed, and there is a stern warning
concerning that, as Allaah, may He be glorified and exalted, says
(interpretation of the meaning): 

“And those who invoke not any other ilaah (god) along with
Allaah, nor kill such person as Allaah has forbidden, except for just cause,
nor commit illegal sexual intercourse ___ and whoever does this shall
receive the punishment.

69. The torment will be doubled to him on the Day of
Resurrection, and he will abide therein in disgrace”

[al-Furqaan 25:68-69] 

Even if we assume that she
deserves to be executed (if she was previously-married and committed zina),
no one should do that but the ruler – as stated above. Moreover, in many
cases killing is done on the basis of accusations and speculation, without
proving whether the immoral action even took place.

Husband forcing his wife to abort a pregnancy

 

What is the ruling on a husband who tries to make his wife abort against her wishes in the second month of pregnancy because he wants to divorce her, by giving her medicine that will cause that to happen, even though he did not manage to bring about an abortion? Is that halaal or haraam? What is the expiation for doing that?.

Praise be to Allaah.
 

 

Aborting a pregnancy is not permissible, whether the soul
has been breathed into the embryo or not, but if that is after the soul
has been breathed in, the prohibition is more emphatic. 

If a husband tells his wife to abort a pregnancy, it is not
permissible for her to obey him. 

Shaykh Muhammad ibn Ibraaheem (may Allaah have mercy on him)
said: 

Trying to abort a pregnancy is not permissible if it is not
proven that the foetus has died; if that is proven then it is permissible. 

Majmoo’ Fataawa al-Shaykh Ibn Ibraaheem,
11/151 

Shaykh Saalih al-Fawzaan (may Allaah preserve him) said: 

Firstly: 

It is not permissible to
abort a pregnancy. Once pregnancy is discovered, it must be protected and it
is haraam for the mother to harm the pregnancy or disturb it in any way,
because it is a trust that Allaah has placed in her womb and it has rights,
so it is not permissible to mistreat it, harm it or destroy it. 

The shar’i evidence indicates that it is haraam to abort a
pregnancy. 

The fact that a baby cannot be born without an operation is
no excuse for abortion; many women only give birth by means of an operation
(i.e., caesarian), so this is no excuse for aborting the pregnancy. 

Secondly: 

If the soul has been breathed into the foetus and it has
started to move, then it is aborted after that and it dies, then (the woman)
is regarded as having killed a soul and she is obliged to offer expiation by
freeing a slave; if that is not possible, then she must fast for two
consecutive months in repentance to Allaah. That is if four months of
pregnancy have passed, because in that case the soul has been breathed into
the foetus. If it is aborted after that, then kafaarah (expiation) as
described must be offered. This is a serious matter which cannot be taken
lightly. If a woman cannot bear a pregnancy for reasons of sickness, then
she has to take medication to prevent getting pregnant in the first place;
she may take contraceptive pills to delay getting pregnant for a while,
until she regains her health and strength. 

Al-Muntaqa, 5/301-302 

Shaykh al-Islam Ibn
Taymiyah (may Allaah have mercy on him) was asked about a man who said to
his wife: “Abort what is in your womb and the sin will be on me.” If she
does that and listens to him, what expiation will they have to offer? 

He replied: 

If she does that, then they both have to offer expiation by
freeing a believing slave; if that is not possible then they have to fast
for two consecutive months and they have to give a male or female slave to
the heir  that did not take part in the killing, and not to the father,
because the father is the one who ordered that he be killed, so he does not
deserve anything. 

“A male or female slave” is the diyah (blood money) for the
foetus, i.e., the value of a male or female slave, which the scholars stated
is equivalent to one-tenth of the diyah for his mother.
